More Napster Woes
Napster will have to pay $26 million in damages and an advance of $10 on future royalties as part of its settlement of a class-action lawsuit filed against the file-sharing service by the National Music Publisher's Association, paving the way for the publishers and songwriters licensing their music to the subscription-based service the company will launch later in the year. The service has been on court-ordered inactivity since July.
Thoten Debuts
Brazilian power/speed metal outfit THOTEN have inked a deal with Italy’s Scarlet Records and will issue their debut album, entitled Beyond The Tomorrow, in January 2002. Produced by ANGRA guitarist Kiko Loureiro (who plays guest lead on several of cuts) and mastered at Germany’s Hollywood Blazers – House of Music (i.e. PRIMAL FEAR, HELLOWEEN), Beyond The Tomorrow showcases the talents of vocalist Renato Tribuzi, who was reportedly on the short list of singers set to replace Andre Matos in ANGRA.
Death Speaks Out
NAPALM DEATH bassist Shane Embury has offered his own comment on the group’s decision to pull out of the Metallenium tour (now featuring SIX FEET UNDER, CANDIRIA, LAMB OF GOD, GOD FORBID and DARKEST HOUR) and vocalist Mark “Barney” Greenway’s recent statement on the political situation in American and events that led to the recent World Trade Center tragedy.

DragonLord On 'The Bone'

Sabbath On Hold
As a result of Capitol Records’ recent buy-out of the Priority label, BLACK SABBATH’s highly-anticipated album of live recordings from 1975, previously known as Live In 75, has been indefinitely put on hold, while the Priority-distributed Divine Recordings (Sharon Osbourne’s record company and the projected label for the above-mentioned release) are presently attempting to figure out if they still have a distribution deal or if they are free to go elsewhere. At the moment, it appears that the CD will be issued through Divine sometime during the first quarter of 2002, although a possibility exists that legal issues may put the release off even further.
While the final track listing has yet to be set, the as-yet-untitled album (the original title has now apparently been scrapped), will reportedly contain all of the previously-released Live at Last album, parts of the widely-available Paris 1970 bootleg, a February 1975 Baltimore, MD unofficial live release, and some of the tracks from the old Beat Club appearances.

MP3.com Reduces Artist Royalties
Vivendi-acquired MP3.com announced that it is going to lower the rates paid to its artists. While participating to MP3.com's "Payback for playback" scheme continues to cost $20 a month, the rates the company pays to artists will be reduced to half a cent ($0.005) for each downloaded song. Artists do not get paid for streaming audio - only downloads. So if you want to participate, you better get that 4,000 downloads a month or you will lose money.
Dust to Dust Has a Type-O Halloween
New York's Dust to Dust has landed the opening slot on Type O Negative's traditional Northeastern US Halloween tour. This comes just as the band came off the road on a stint with Dave Navarro.
Two Weeks of Iced 'Deth
Iced Earth will be the opening act at two weeks’ worth of dates on Megadeth’s US tour, starting on October 20th in Cedar Point, North Carolina. According to Megadeth bassist Dave Ellefson, “we figured it best to continue a good thing with this than take a break and come back with a second leg [of our headlining tour] and I think Iced Earth will rock everyone's world.”
In related news, Iced Earth will now NOT be able to join Judas Priest their rescheduled US tour, because of Iced Earth's European touring commitments, which were already rescheduled once for the Priest tour.

James Murphy Diagnosed w/ Brain Tumor
According to Blabbermouth.net, former Testament/Death/Obituary guitarist James Murphy has reportedly been diagnosed with an undisclosed type of brain tumor and is at home in Florida recovering from a recent emergency operation that is believed to have successfully prevented the disease from progressing to a more advanced stage. At the time of Murphy’s diagnosis, he was said to be working on the material for a long-awaited sophomore offering from his death metal project Disincarnate for a 2002 release through Nuclear Blast Records. It is unclear what impact this latest development will have on the guitarist’s future recording plans.
Witchery Joins The Haunted
After pulling out of Metallenium, Sweden's Witchery are scheduled to come back to North America as support for The Haunted. Guitarist Patrik Jensen happens to play in both bands and will be playing double duty for the duration of this tour. Apparently, Jensen is prepared to weather the tour, which will include The Haunted, Krisiun and Cryptopsy.
