Metallica Singer James Hetfield Angers Bikers, Hikers And Others

Blabbermouth.net reports: Mark Prado of the Marin Independent Journal reports that METALLICA guitarist/vocalist James Hetfield has erected a metal fence (Photo) on his property on a Terra Linda (California) hilltop, closing off a popular trail and angering hikers, bikers and equestrians.
Someone scrawled "SHAME DISGRACE" on the 300-foot-long, 8-to 10-foot-high corrugated metal silver fence adorned with barbed wire at its far edges.
"Look at the barbed wire. This a serious fence," said hiker Tom McMillan of San Rafael, as he walked along the shiny behemoth late last week.
The fence, at the end of a fire road in the Terra Linda-Sleepy Hollow Divide open space preserve, went up in its present configuration in the past several weeks, according to trail users.
For one of the few times in recent memory, bikers, hikers and equestrians — groups often at odds on trail access issues — are coming together to criticize the fence, saying it blocks access from the Luiz Ranch Fire Road that dates back more than 50 years.
"I now have to get on the road with cars and go another three to seven miles to get to where I want to go," said biker David Lazarini of San Rafael. "It was always open, and it has changed suddenly."
But David Warner of Redhorse Constructors Inc. of San Rafael said vandalism of a previous, smaller gate, and of signs and other property along the trail, prompted Hetfield to block access with the large structure.
"It is private property," said Warner, who does construction work for the rocker. "There was some damage done by certain people. If people were cool, this would not be an issue."

Actually I'm gonna side with Hetfield on this one. The fact is that the area in question is HIS property and he wants to build a fence to stop people trespassing on his land than he's more than entitled to it. Plus I dunno about America but here hikers and bikers etc take whatever opportunity they get to complain lol. A better example would be my house where the council erected a metal fence directly on a public footpath which prevented people from getting to places, including home and work, with no warning whatsoever. Of course Britain being Britain, we just kept trashing it 'til they got rid of it.

All they have ever done is defend their turf. They did it with Napster and now James is having to do it again here. If people are wrecking your stuff or stealing your music then you have to do what you got to do. All he did was piss of a bunch of granola eating hippies anyway. It always seems that a small group of turds ruins it for the larger group. But the people that wrecked the stuff can't possibly be at fault. James shouldn't have had it there in the first place. I do not know when it became cool to bag on these guys all the time but it is sure getting old. The band is probably the most influential ever to heavy music.

Leave it to those type to whine and complain whenever someone inconveniences them in some way, and especially when nature is involved. Apparently they are too stupid to read the "No Trespassing" signs, or too damned arrogant to care. Not only that, but some people vandalized the gate and signs, so what the hell do they expect? It's someone's property, and trespassing is a crime. Simple as that.

I could care less what Hetfield does with his own private property. He can do whatever he wants with it. Classifying the biking scene in marin as granola eating dirty hippies is pretty funny tho. Most of those mountain bikers are pretty hardcore guys and quite a few badasses I wouldn't wanna phuq with haha. They're alot closer to skateboarders than hippies.

If anyone was not on Hetfield's side on this one, that would be complete stupidity. This is total common sense. First n foremost, it's HIS f***in' property. Private Property. Secondly, the only people complainin' are flippin' flappin' hikers, bikers, n 'equestrians' (equestrians aren't important though). But, as for the hikers and bikers, they shouldn't mind going an extra 3-7 miles to get to where they wanna go...sense they just love to get out so much...ugh, makes me sick. These people need to complain for more important things, like saving the environment R somethin' rather than going against an actual law to get what they want. Spoiled p***ies.

Actually, there is a good chance that Hetfield will probably going to loose this one if it makes it to court. If these people can show that the trail has been used for 50 years, and Hetfield knew about it when he bought the land and continued to allow the use, then they will be able to prove to a court that there is a "constructive easement", and public users will continue to have a right to continue use of the trail for the stated purpose of accessing the other land, even though Hetfield owns the actual land that the path is on. Pretty standard property law doctrine. If the people are causing damage, that "could" impact the case, but most likely Hetfield would then probably only be entitled to damages from users. And yes, I am a licensed attorney, and I do know what I am talking about.
Simply put, this ain't as simple as "its his land, and he gets to use it as he pleases."
