Walmart Sued Over Evanescence
Major US retail chain Wal-Mart is being sued over its decision to stock the Evanescence CD/DVD 'Anywhere But Home'. The law suit has been taken out by Trevin Skeens from Brownsville, who claims that the store has no sticker on the release to warn people that the song 'Thoughtless' contains a profanity. Skeens is demanding that Wal-Mart either censor the release, or remove it from the shelves of its Maryland outlets. He's also seeking compensation.

Boo-friggin-hoo, you bought a DVD and theres a bad word on it. Oh my goodness, better cover your ears when you walk down the street, and when you get on the bus, and when you go into WALMART!!!! You hear swearing EVERYWHERE, and you're going to complain about an Evanesence DVD?! What is wrong with this picture? What a moron... AND he's seeking compensation? Compensation for what? Are your eardrums bleeding because you heard a naughty word? Give me a break. I don't even like Evanescence, but something tells me their songs don't consist of a whole lot of senseless swearing. Where does he get off sueing Walmart anyway? How is it their fault that the stickers weren't on the product? I hope the courts throw this out and both Walmart and the judge tells this whiney little moron Trevin Skeens he needs to grow up and get a real job.

ahh man thats bull if they are gonna buy a rock and roll dvd you had better expect there to be at least a few bad word i mean its not like its slipknot or anything ,that guy needs to go home back to his mommy and tell it to all go away .thats just my opinion.

This strikes me as little more than an opportunist and a sliver of sunlight they see as a wide path to personal gain. This whole issue is about packaging. The consumer is mad because the Evanescence DVD/CDs weren't labeled with a Parental Advisory sticker and it had a bad word in one of the songs. So... are we to expect Wal-Mart to open every CD, DVD, video game (PC or console), magazine, and book and read/listen to the entire thing to make sure it's labeled properly? If this guy was just charging the record label and production house for mislabeling an artist, who probably should have had the sticker on there to satisfy legal obligations, he would have more credibility. But to sue the band, Wal-Mart, and everyone else just makes the guy look petty. How on earth is Wal-Mart supposed to know there is a swear word on an album and no label? They carry so many hundreds of album, books, games etc. that there are probably other products that are mislabeled. It is unreasonable to expect a company the size of Wal-Mart to open and listen to every CD they sell. This guy is a nut.

Yeh.. next thing people will be sueing for checkin out a cd in a store that has swear words in the song names... or even worse in the title!! Nevermind the swearing...this guy obviously hasn't looked at the actual covers of some of the stuff out there....eg..cannibal corpse... What a bloody a**hole...must of taken him ages to come up with such an ingenious plan!! muahaha! I say walmart sue him for being an idiot and wasting court time!

Oh they should tell this idiot to just get over it. How many artists don't use any profanity at all these days? But because Wal Mart is a "family" company, which means they're a bunch of p***ies, they'll pull the CD from the shelves.
