Ellefson Appeals Ruling In Suit Against Megadeth

According to The Hollywood Reporter, former MEGADETH bassist David Ellefson's attorney, Randall Jacobs, said he has already filed a notice of appeal in regards to the recently dismissed lawsuit against Dave Mustaine.

As previously reported, a federal judge in New York recently dismissed a suit filed by Ellefson against Mustaine and the Megadeth's corporate entities.

In a suit filed in July, Ellefson had disputed the legitimacy of a May 2004 settlement agreement with Mustaine and the group, and had sought at least $18.5 million in damages. U.S. District Court Judge Naomi Reice Buchwald tossed out Ellefson's action on January 13th.

A countersuit filed by Mustaine in California Superior Court against Ellefson remains pending.
