A copy of MÖTLEY CRÜE's actual legal lawsuit document filed on Tuesday (May 24) against NBC for banning the group after lead singer Vince Neil used an expletive during a live broadcast of "The Tonight Show With Jay Leno" has been made available for download as a .ZIP file at this location (700 KB).
According to the Associated Press, the federal lawsuit, filed in Los Angeles, accuses the network of violating the band's free-speech rights and hurting its record sales by barring it from NBC shows to placate the Federal Communications Commission. The suit seeks a court order lifting the ban as well as unspecified damages.
Neil used the f-word during the live New Year's Eve broadcast as he yelled a greeting to bandmate Tommy Lee shortly after midnight.
Though carried live on the East Coast, the remark was excised in other time zones. Neil was unaware his statement was aired live, according to the lawsuit. The FCC said it received complaints about the broadcast.
The lawsuit accuses NBC of singling out the group, saying network officials stopped short of banning other artists who swore on-air, including U2 frontman Bono, who used the same expletive at last year's Golden Globe Awards.
"This is about fair and equal treatment. We have a right to be treated in the same way as other artists who have made the same mistake," bassist Nikki Sixx said in a statement.
The network dismissed the lawsuit as meritless.
"To ensure compliance with its broadcast standards, NBC has the right to decide not to invite back guests who violate those standards and use an expletive during a live entertainment program," the company said in statement. "We will defend the case vigorously and we fully expect to prevail."
The group claims a planned appearance on NBC's "Last Call With Carson Daly" was canceled, while it was prohibited from other network programs. That allegedly cost it media exposure that weakened ticket, merchandise and album sales, the suit claims.
The lawsuit questions why NBC announced that Lee would appear individually in an upcoming television reality show despite the ban, contending the network censored the group as a whole to mollify federal officials so it would avoid sanctions against its business.

Colorado’s Jag Panzer and Century Media Records will release a strictly limited 7” on black vinyl (500 copies only) around Jag Panzer's appearance on this year’s Bang Your Head festival.
For this collector’s item the band recorded a cover-version of “The Wreck Of The Edmund Fitzgerald”, originally by Gordon Lightfoot. The b-side will feature “The Mission (1943)” from their current album “Casting The Stones”.
Guitarist Mark Briody explains the unique choice for a cover-version:
I’ve always loved dramatic, epic music. Songs like “Heaven And Hell” or “Beyond The Realms Of Death” quickly became favorites of mine. But my introduction to this type of song wasn’t even a heavy metal song. The song that first caught my attention was a dark tragic tale of a shipwreck in the Great Lakes. The song was called “The Wreck of the Edmund Fitzgerald” and it retold the true story of the sinking of the freighter ship Edmund Fitzgerald. I remember taking my small transistor radio to bed and listening to the radio all night just to hear this song.
The 7” will be available at Bang Your Head, Heavy Magazine, the band and Century Media’s mail order.

Oakland-based purveyors of violence Watch Them Die have recently crafted a stunning new offering, "Bastard Son," which is a multi-layered exploration of anger, pain, loss and redemption. The highly anticipated new offering is currently being mixed by Tue Madsen (Heaven Shall Burn, Himsa, The Haunted) in Denmark; expect an early fall release. The group’s metal crusade begins this summer with a two-month trek supporting Soilent Green. The list of tourdates is below.
Whether you’re talking about legendary speed pioneers like Exodus or masters of heaviness like Sleep and Neurosis, the Bay Area has always been a breeding ground for various forms of extreme music and expression. Watch Them Die have fearlessly positioned themselves as heirs to this crushing tradition of excellence, confronting a metal heritage that has left many an inferior band swimming in their own blood and excrement.
With "Bastard Son," Watch Them Die have raised the bar, crafting a record that will be a formidable calling card on their planned two year obliteration of the U.S. and Europe in 2005-2006. The group also presents a multi-dimensional, unapologetic reflection of reality that is definitely not for the weak or timid. Bastard Son is simply raw metal violence unleashed.

An article posted on mlive.com reveals that Porcupine Tree's "Deadwing" is inspired by a screenplay Porcupine Tree leader Steven Wilson wrote with friend and filmmaker Mark Bennion. Several excerpts from the article:
"I've always been very interested in cinema, and that's why the music has that feeling to it," Wilson said in a telephone interview. "I didn't have anything specific, lyrically, that I wanted to write about this time, so it seemed like a good idea to use the script as inspiration."
The "Deadwing" film has yet to be made, but Wilson hopes interest in the script stirred by the CD will help him and Bennion procure financing for it. Wilson calls the screenplay a "surreal ghost story" that doesn't stray too far from the dark themes he often delves into while writing music.
"The album is not trying to tell the story of the script, it's more a case of being inspired by certain themes and flavors and characters in the script," he said. "But it's very much an equivalent to the music of Porcupine Tree. It's very melancholic, it's very dreamlike, it's quite European in flavor -- in the sense that it's not a Hollywood movie by any stretch -- with a dark ending. We're both influenced by two American directors, Stanley Kubrick and David Lynch. We're very much in that tradition."

FortWayne.com reports that Motley Crue frontman Vince Neil is getting into a new kind of spirit – he has joined a wine-making venture called Vince Vineyards.
“I have enjoyed great wine for most of my life and wanted to create something other wine lovers could experience and appreciate,” Neil said in a statement.
Neil, 44, plans to start with 500 cases of 2003 Napa Cabernet Sauvignon and 250 cases of 2003 Sonoma Chardonnay.
The heavy metal singer will have little to do with the actual winemaking – Harry Parducci at Adler Fels Winery in Santa Rosa, Calif., will produce the wine. It will be sold for about $20 a bottle in Las Vegas, where Neil lives, as well as Los Angeles; Nashville, Tenn.; and New York.

To promote their new album, Karma and Effect (in stores now), Seether came back to Vancouver, BC on May 19th for a very small and private show at the Media Club. There were two main ways to get into the show: either win to get in through the local rock radio station (The Fox 99.3) or be one of the first 120 fans to show up on the day of the show with donations for the food bank. Since the release of their Wind-up debut album, Disclaimer, Seether has performed in Vancouver, BC twice before – once with Our Lady Peace and Finger Eleven in January 2003 and again with Evanescence last July, both of which were big stadium shows. I had caught the OLP show but it was quite a while ago and I can’t remember much. However, I do remember that the OLP fans didn’t quite seem to enjoy their set or F11’s, which isn’t very surprising given the musical differences between the bands. The crowd reaction inside this time was definitely a big improvement over that of the OLP audience. More...
