The Associated Press has issued the following report:
The judge in the nightclub fire criminal case said he will hear arguments about whether defense lawyers can resume questionning grand jurors, after the state said it was improper.
Lawyers for nightclub owners Jeffrey and Michael Derderian have said most of the jurors who indicted their clients missed at least some testimony, and at least one never received a tape or transcript of the testimony that was missed.
The lawyers want to interview the jurors about the absences — a possible step to asking that the indictments be thrown out.
On Monday, the state filed a motion asking the defendants to detail why they should be allowed to talk to the grand jurors who indicted the Derderians and Dan Biechele, the former tour manager for the band GREAT WHITE.
Each man faces 200 counts of involuntary manslaughter for the Feb. 20, 2003, fire, which killed 100 people, including eight who lived or worked in Connecticut. All have pleaded innocent. More...
Massachusetts' The Hostage Heart have decided to call it quits. No official reason for the move has been released, however a member of the band recently quit due to "personal problems," apparently precipitating the dissolution of the band. The group is expected to play the remainder of their booked shows (see below). Formed in 2002, the band signed a two-album deal with United Edge Records in December. The Hostage Heart's final shows include:

Launch Radio Networks reports: SYSTEM OF A DOWN has yet to deal with any repercussions from its "Saturday Night Live" appearance this past weekend (May 7), in which guitarist Daron Malakian got a spontaneous cry of "Fuck yeah!" past NBC-TV censors during the band's performance of its current single, "B.Y.O.B." The use of the F-word in the song's actual lyrics was muted during the broadcast.
SYSTEM OF A DOWN have been fierce supporters of free expression, and Malakian recently told Launch he'd like to see more rock artists take a stronger position on it. "In the Sixties, all these bands had the balls to get up and speak against the government, even though it wouldn't look good in the society, whatever," he said. "They said their mind because they thought it was right. And now you've got all these rock and roll guys, they don't even the balls to even say what they want because they're so afraid of their careers — that's not real rock and roll, man."
There has been no comment from NBC on the "SNL" incident and, so far, no outcry from conservative or religious groups.
"B.Y.O.B." comes off the band's new album, "Mezmerize", which is due out on May 17.

New Jersey's SOIHADTOSHOOTHIM will be entering Atomic Studios in Brooklyn to record "Alpha Males And Popular Girls", their debut full length and first release with Crucial Blast. The band will be working with veteran engineer Dean Baltulonis (Sick Of It All, American Nightmare). "Alpha Males..." will be released on November 22nd, 2005.
Akercocke can finally confirm former Berzerker shred Master Matt Wilcock as their new guitarist. After surviving his recent Satanic baptism with great aplomb at a one-off show in Hamburg, Mr Wilcock was offered the position which he duly accepted. The Satanic Death Metallers are currently planning a short run of UK dates before heading to the studio this Summer to record the fourth as yet untitled album.
Norway's Damage Control recently finished recording their new EP, titled "So Hard To See." The 7"/CDep release will be available this summer through Livewire Records. In related news, the group will be touring the U.S. this fall.
Sweden's Burst have begun the recording of their forthcoming full-length album, entitled "Origo."
The band has entered the legendary Music-A-Matic Studios (Kent, Union Carbide Productions, Millencolin, Broder Daniel) in Gothenburg, Sweden with longtime producer Frederick Rheindahl and Henrik Lipp and have begun recording "Origo," the follow up to their critically acclaimed Relapse debut "Prey On Life."
Bassist Jesper Liverod states: "'Origo' is an exaggeration of everything that Burst is about. Never before in the history of this band has the music felt so urgently important to us. 'Origo' is fundamental in our lives."
Burst's "Origo" is slated for a fall 2005 release via Relapse.
In Flames frontman Anders has posted the following message on the band's official website:
Anders here. I’m in Dug out studio recording my vocals for our new album. Want the title.....drumroll......”CRAWL THROUGH KNIVES”. Yes there it is my friends. Now you can speculate and decide if you will like the album or not....... irony is a wonderful thing.
Everything is going great 8 out of 13 songs done and some titles are: Crawl through knives, Dead end, Leeches, Surrender?, Reflect the storm, Take this life. I feel it’s a good mix of everything IN FLAMES stands for, but it’s me speaking....
Next week we’ll start mixing in Tonteknink/Umeå and at the end of May the album is DONE.

Shadows Fall have had a triumphant year thus far, as they just completed a highly successful U.S. arena tour alongside Slipknot while their critically acclaimed album, "The War Within," recently surpassed the 200,000 U.S. SoundScan plateau. Things are only just beginning to heat up for the group as they’re set to perform on the main stage at Ozzfest this summer, thereby not only becoming the first band of the New Wave of American Heavy Metal genre to achieve that honor, but one of the few in history to make the leap from the second stage to the main stage. Early next month, Shadows Fall will also make their way back to Europe for a few shows with Slipknot along with some major festival appearances including Download, Rock im Park and Rock am Ring, alongside delivering a special performance at the prestigious Metal Hammer awards.
The group’s latest single for “Inspiration On Demand” has exploded at commercial radio and recently broke into the top 40 on the R&R Active Rock chart. The video for the track has also been greatly embraced by Fuse, MTV2 and MTVU, who recently added it to their “Freshman” playlist. Shadows Fall were also recently named one of VH1’s “Hear and Now: Five Massive Metal Mongers You Should Turn Up” and a “Band To Watch In 2005” by Stuff magazine. The War Within ranked as the third best album of 2004 in Revolver magazine’s coveted Reader’s Poll, while their track “The Power of I and I” also scored the fifth spot in the “Best Song” category.
Hammerfall guitarist Oscar Dronjak has posted the following message on the group's official web site:
Japan and South America await in the next weeks, and we can't wait to get back to these territories! There have been some changes to the Mexican, Chilean and Brazailian shows, so please check out the tour section for further details. As I said before, Twisted Sister cancelled so we had to change a few things around, but nothing major.
At last, we have the North American dates and venues are in, and it looks like a loaded three weeks! The tour is lodged between Wacken Open Air and Bloodstock, so the schedule is quite stressed. But I think both Hammerfall and Edguy will endure. Check out the tour date section for all the info regarding this leg.
The show in Göteborg was a huge success! All in all, there were 5500 people there to experience this with us, and the atmosphere was tremendous! Thanks to each and every one of you who showed up and made this a night we will never forget. And of course a big thanks and good luck for the future to Pretty Maids, Thunderstone, Firewind and Lordi, it was a short but very intense and fun tour. See you down the road!

A 26-minute video interview (in German) with Accept founding members Peter Baltes (bass) and Wolf Hoffmann (guitar), conducted in the band's rehearsal room, has been made available for download as part of the latest "Bleeding for Metal" TV special. The interview contains background information about the group's current status and includes a journey through the history of the most important German heavy metal band which recently reunited for European festivals and a Japanese tour after being inactive for over nine years. Anthrax, who are currently touring with their famous eighties line-up featuring Joey Belladonna (vocals), Scott Ian (guitar), Dan Spitz (guitar), Frank Bello (bass), and Charlie Benante (drums), announced plans to film a live DVD during their show in Saryeville/New Jersey on June 3.
For this event, which marks the only date on the East Coast so far, Anthrax also announced that the first 300 ticket buyers will get to hang with the band for a private soundcheck.
German traditional metallers Edguy are working all guns blazing on their forthcoming EP "Superheroes" which is scheduled for September. Producing is Sascha Paeth (Kamelot, Aina, Rhapsody) at the Gates Studio in Wolfsburg. Apart from the mid-tempo title track none of the featured songs will be found on the forthcoming album.
About the material singer Tobias Sammet says: "Working with Sascha is incredibly refreshing. The new shit kicks ass, sounds cheeky at times but always fresh. An up-to-date production, still pompous and big... On the EP there will be five songs, one is going to be an overlong up-tempo epic track, for which we are maybe going to invite some of my Avantasia buddies to share some vocals with me. This would suit this song so damn well, so it’s a must. That being said: We won’t need to hype it as an all-star super project, there have been much too many already anyway. And I think the stuff is strong enough to speak for itself."
Edguy will embark on an US tour with Hammerfall in the summer. Tour dates can be found here.
Californian thrashers Exodus recently announced that health reasons forced drummer Tom Hunting to step down from the recording of the upcoming album, scheduled for a September release. He will be replaced by Paul Bostaph, who is no stranger to thrash fans: he played with Forbidden, Testament, and Slayer.
As guitarist Gary Holt posted, "Tom has fallen very ill, he's been hospitalized several times over the course of the last two months." Holt also stressed that this development "is in no way associated to drugs: Tom had conquered his addiction well over a year ago. By no means was Tom fired or nor did Tom quit Exodus, but his health must come before any obligations to the band."
On Tuesday, P.O.D. entered the studio with 5-time Grammy award winner Glen Ballard. For the past five months P.O.D. have been writing and demo-ing material. It's been a powerful creative journey that started in San Diego, and then to Palm Springs, San Francisco, back to San Diego and now to LA.
On Friday, May 20th, MuDvAyNe will perform "Happy?" on "Late Night with Conan O'Brien". Check your local listings for times, mark your calendars and set your TiVo's.
Iron Maiden have confirmed they are to release a Double DVD and Live Album titled “Death on the Road” through EMI Records on August 29th 2005.
The show was filmed at the Westfalenhalle Arena, Dortmund, Germany during the Dance of Death European Tour in December 2003 and fully captures the magnificent stage production and electricity of the band’s performance. Steve Harris once again took weeks personally editing the footage and like Rock in Rio this means thousands of cuts right into the heart of the action.
Says Steve Harris, “The shows on that tour were perhaps far more theatrical than some of our recent tours so it has a very different feel than that of, say, Rock in Rio which was a massive festival environment. The 115 minute show was originally filmed by VIVA TV in Germany to broadcast across their national TV network a few days afterwards. However TV and DVD are always very different mainly owing to the time restrictions. So we’ve spent time starting from the bare bones to create a full length concert feature that captures the excitement of the show but also the drama as well. I think when people see songs like Paschendale and Dance Of Death they’ll be blown away by the spectacle. At the same time there are some great moments in Journeyman that I think will surprise a few people. Iron Maiden with acoustic guitars?! I’m really happy with the end result as it captures the dark and lighter moments perfectly.”
The album and PCM Stereo / 5.1 Surround sound for the DVD has been mixed and produced by Kevin ‘Caveman’ Shirley and co-produced, as always, by Steve Harris.
The Double DVD also features a full 70-minute documentary directed by Matthew Amos charting the album’s creation and then subsequent preparations for the following tour. The feature length program includes candid and personal footage of the band during the recording and writing of the album, which is the first time it’s ever been filmed.
Says Manager Rod Smallwood, “The documentary is something quite special for the fans as it really is a very revealing portrait of how Maiden work together recording and it took me hours to persuade them to let the cameras in the recording studio. Previously they’d never allowed any of that to be filmed but this time we decided to have a camera floating around to try and capture the Maiden recording process. A lot of it was filmed by the Kevin Shirley and the band themselves. I think it’s a great representation of the talent, effort and humour of a Maiden recording session. The documentary also covers what it takes to set up a major World Tour and has various interviews with our Killer Krew and hopefully it will be as insightful and interesting as the well received Early Days documentary footage.
“As usual we have crammed as much as possible into the DVD’s with a host of extras including all of the promo videos from the album, footage of the band performing in South America, background interviews with members of the production crew and fans along the tour, artwork and photo galleries. Many hours of Maiden mayhem.
“Like Rock in Rio we have again decided to release a DVD and CD. Those who have DVD players will presumably opt for the DVD but we wanted to ensure all fans could get at least the audio of this tour and many countries of the World do not have widespread capacity to play DVDs.”

We had a great time at Mad Oak studios in Boston!! Everyone pulled out stellar performances, especially Mr. 7. You can all look forward to some exciting drumming on this record. Back on the west coast now preparing to do some mixes with none other than our old friend Mudrock. CELTIC FROST frontman Tom Gabriel Fischer has posted the following message on his official blog:
"We finished the demonstration songs yesterday. They will be used for various industry purposes. We focused entirely on heavy material, and these songs are a clear indication of what the album is going to be like, they are dark, ferocious, sometimes very unique, and very intense. The full album will be more varied, but the general direction is obvious.
"All the recordings were made at our rehearsal studio, and we used live versions for most of the tracks. We spent Sunday mixing at Oakland Recording in Winterthur, Switzerland. Erol [guitar] engineered, and Martin [bass] and me managed to annoy him constantly with our demands/comments/immaturities.
"Almost everything came out as intended. The only song that doesn't yet work is 'Os Abysmi vel Daath'. This is a bitter pill to swallow, for it is one of our earliest dark songs for the new album, and we had a lot of faith in it. We will have to go back and put some very concise work into it. The song seems so simple, and yet it is very complex and has managed to defeat us every step of the way so far.
"The other songs of the demo sound extremely CELTIC FROST to me, in details sometimes astonishingly close to 'Morbid Tales' or 'To Mega Therion'. 'Ain Elohim' and 'Temple of Depression' are perhaps my favourites among these songs. Although it is a new song, the title and some of my contributions to 'Temple of Depression' go back to the original CELTIC FROST of many years ago.
"If all goes according to plan, Martin is going to pick up a well-known Swedish producer from the airport in just a few hours. We'll talk for a day about a possible collaboration, and he'll hear almost the entire album on Tuesday."

This is not only a loss for us as a band and his family, but also millions of metalheads throughout the world. David died due to complications from injuries he sustained in a head-on automobile accident several months ago.
"David Wayne was the patented scratchy vocals of several METAL CHURCH albums and was in the process of returning to the metal scene with his new band lineup. His goal was to return to the sounds of METAL CHURCH's albums released in 1984 and 1986. We will always remember the burning words and vocals in 'Gods of Wrath', 'Watch the Children Pray', and 'Start the Fire'. David and his current band had just completed several new songs and were ready to head to the recording studio after their European tour dates this summer.

Hardcore band Betrayed, featuring members of Champion, etc., have officially joined the Bridge Nine Records roster. The group features Aram Arslanian (Champion) on vocals, Todd Jones (Carry On) on guitar, Greg Bacon (Stand & Fight, etc.) on bass, and Todd Preboski (Champion) on drums. Their new EP, titled "Addiction," features six songs and will be available on July 12th. You can download a song from the effort here.
Remember the onstage drama during Chaosfest? Apparently both From A Second Story Window and Blood In/Blood Out have put aside their differences to put on a show together. States Derek Vasconi of From A Second Story Window:
"I understand where they were comming from. If anyone was getting offensive with our friends we would have done the same thing. It was all just a misunderstanding and I am hoping for this show to be the end of all the drama."
The show will take place on June 5th at 653 Railroad Ave. in Round Lake, IL. Also performing will be Ion Dissonance, On Broken Wings, Carnivale, and Afterproject.
"Behold Judas" From the new Hate Eternal Album "I, Monach" can be downloaded from this location. Hate Eternal recently finished recording "I, Monach," which is scheduled for a June 27 released through Earache Records.
