Michael Scott Axley has been convicted of felony murder and aggravated assault charges after he punched and killed Andy Richardson at the Family Values Tour stop in Atlanta, GA last year.
The victim, 30-year-old Andy Richardson of Atlanta, was attending a concert by KORN at the HiFi Buys Ampitheater. Atlanta police homicide Detective Brett Zimbrick testified at the hearing that Richardson was knocked to the ground by a punch from Axley, fatally hit his head on the concrete floor at the former Lakewood Ampitheater and was punched twice more as he lay unconscious.
UPDATE: As pointed out by moko in the comments (and confirmed by other sources), Axley was indicted on the charges of felony murder and aggravated assault, not convicted.
Seether has some updates for us on their upcoming album on their MySpace blog. Here is what Shaun had to say on it:
"We've been very busy, holed away in a studio, writing feverishly for the next album. So far the songs number in the mid 30's or so, but I could be wrong. Of these songs I'll be the first to admit that some are serious duds, headed for the inevitable distinction of being included on a b-side, or rare track, compilation album. There are even some songs that will be marked 'For Serious Fans Only!', but there is good news... There are actually some songs that I'm really proud of, and very excited to get out on the shelves. Let's say there are about 15 good ones so far, but the writing continues!!!"
"We have switched management, as some of you might know, and are now under the watchful eyes of the good people at The Firm. We felt the changes were necessary, and as a band we feel really positive about the move. Also, we have the honor to announce that we will be working a wonderful producer on the next album, and preproduction is scheduled to start soon, I think. I'm just in the band - no one tells us anything :). I would give you his name, but I don't want to get myself in trouble again. I have a knack for that apparently."
The Chariot have posted a new song, "They Faced Each Other," off their upcoming album, "The Fiancée." You can check out the new song on their MySpace page. The Chariot's new album, "The Fiancée" hits stores April 3rd via Solid State Records.
Bloodjinn has now posted a third new song from their upcoming release, This Machine Runs On Empty, which is set to hit stores across the country on March 6th. Visit their MySpace page to check out "Inhale Exhale", as well as "Truth Within" and "In The First Degree".

Poison The Well will be returning to Warped Tour this summer in support of their long awaited new album, 'Versions'. You can check out a new track from Versions on the band's MySpace page. Poison The Well started their first run of dates since completing 'Versions' yesterday. They'll be on the road with This Is Hell and The End through the South East and will later kick off a full US tour for the month of April with Fear Before The March Of Flames and Heavy Heavy Low Low.
Montreal, Quebec's NEURAXIS have started an online tour diary documenting their experiences on their current trek across Europe. The Domination Tour 2007, featuring Rotting Christ, Malevolent Creation, Incantation, NEURAXIS, and others began on February 14th and will run until March 4th. The tour diary is available via NEURAXIS' MySpace page.

Pittsburgh's CIRCLE OF DEAD CHILDREN have added drummer Matt Francis to their line-up. Vocalist Joe Horvath comments:
"At a point when we had all but thrown dirt over our own casket, life has once more been injected with the vacancy of the drum position being finally filled. Binghamton, New York’s, Matt Francis has recently joined CIRCLE OF DEAD CHILDREN and we plan to soon begin work on a yet-to-be-titled sixth release due out during the summer of 2007, on Willowtip Records. Matt’s addition to CODC drives the band to its most caustic and explosive level to date. Blackened iron hails to the fans and fellow bands who have pushed us through the downtimes and continue to support us into the future. Keep screaming."
Robert Flynn, Machine Head frontman is set to finish his vocals for an as-yet-untitled new song, which is to be used as a bonus track/b-side in correlation with the band’s forthcoming sixth studio album ‘The Blackening’
‘Aesthetics of Hate’ is a new song available for download from this location. The track which is taken from ‘The Blackening’ was inspired by an article written by William Grim, labelled "Aesthetics of Hate: R.I.P. Dimebag Abbott, & Good Riddance", Robert Flynn said of the article:
"It basically said that Dime was untalented and that he reaped what he sowed," Flynn told MTV.com about the article. (Grim called Abbott "an ignorant, barbaric, untalented possessor of a guitar" who looks "more simian than human" and "part of a generation that has confused sputum with art and involuntary reflex actions with emotion"). "It's one thing to have an opinion about an artist, but the thing that was the most offensive to me was how it then went on to cast this huge generalization over the metal community, calling us pathetic for mourning his death. He called us all ugly and fat. I wanted to punch the fucking computer screen when I read that article."

Dream Theater have confirmed the final track listing of their impending new album, Systematic Chaos:

The band just mastered the album on Wednesday and it was to be in the hands of Roadrunner Records on Thursday. Produced by Portnoy and guitarist John Petrucci, "Systematic Chaos" is Dream Theater's ninth studio album and Roadrunner debut, and will be out this summer.

HORDES OF THE MORNING STAR will soon begin work on their debut full length album, tentatively titled "Dawn of the Final Holocaust". This release should see the light of day in December 2007/January 2008. You can check out "Ashes" and "Ceremony" from their previously released "Torture" EP on their MySpace page.
Noise/gore/grind splatterfiends INTESTINAL DISGORGE have begun work on their next full length CD. The band is currently investigating the possibility of releasing this album on a larger, more established label, but if nothing pans out from that, it will be another independent release on Pray for Death, pro-pressed, and available June/July 2007. The video for the title track 'Unsu' from LYZANXIA's latest album 'UNSU' is now available at the video section of the band's website.
The video for 'Unsu' was directed by Guillaume Pin, who also directed 'Medulla Need' (Lyzanxia) , and 'Screams of Dying Dogs (Phaze I) and features a very special guest appearance from karate world champion Myriam Szkudlarek performing the actual Unsu kata which the album and title track take their name from.
Tortured post metal band KRUGER have uploaded two new songs to their MySpace page from their upcoming album "Redemption through Looseness." "Redemption through Looseness" is to be released in Europe on April 10th.
Canadian death metallers CRYPTOPSY have announced the following Japanese tour dates:

Grey Skies Fallen have posted a live video of a six minute sample of a new song, which will be 21 minutes in length. The song is expected to appear on the upcoming new album. The video can be viewed here and on their Myspace page. More...
In a move certain to surprise almost no one, Guns N' Roses has once again pushed back the release date of the band's long-awaited, oft-delayed album, "Chinese Democracy," reports liveDaily.com.
The band's frontman, Axl Rose, had announced back in December a tentative release date of March 6 for the album, which would be GN'R's first studio set since 1991's "Use Your Illusion." At the time Rose made the statement, the singer was explaining the cancellation of the band's January tour, ostensibly to stay in the studio and finish the album.
"It takes approximately eight weeks for an album to hit the shelves once it has been turned in to the record company," Rose said in December. "For whatever reasons, it appears that it may have been mistakenly inferred by management that this time period could be condensed to three weeks. With that being said, this is not a promise, a lie or a guarantee, but we do wish to announce a tentative release date of March 6."
In a new posting on the band's website, however, the group offers no release date for the disc, official or tentative.
"The good news is that all of the recording for the album has been completed," the message, signed by the band's longtime road manager and Rose confidant Del James, states. "Drummer Frank Ferrer and guitarist Ron 'Bumblefoot' Thal integrated themselves into the recordings seamlessly and will have their presence felt.
"There is no official release date, as the band is currently mixing, but after some delays and scheduling difficulties, things appear to be moving along."
The current delay is merely the latest in a long string for "Chinese Democracy," which Rose has been working on for over a decade. During that time, GN'R has gone through several lineup changes, and even toured extensively in 2002 under the banner of "The Chinese Democracy Tour." The group has made several unofficial live appearances since Rose's December announcement, including one at an early February gala on Rodeo Drive in Beverly Hills honoring Donatella and the late Gianni Versace.
Lamb of God have been rumored to be part of the 2007 edition of the Family Values Tour with Korn, Evanescence and Aiden. More info will be announced in the coming weeks. Despite their listing on the Virgin Records e-card, the band has not committed to the tour and are still finalizing their summer tour plans.

Gwynbleidd is currently finalizing the dates for the upcoming recording session of the debut full length album "Nostalgia". Just recently, the band has taken part in four unique in-theater performances with the infamous Ballet Deviare (www.balletdeviare.org) as well as taken to the stage during the Heathen Crusade Festival (www.heathencrusade.com) in Minnesota. More news on the upcoming full length album, planned for late 2007 release, will follow within the next months.

Burning Star Records have announced the signing of Sweden's cult metal act The Equinox Ov The Gods. One of Sweden's long-running metal acts, the band was formed in 1990. Their new album is scheduled for an early summer release date.
From Athens, Ohio, Dead Will Rise brings something new to the Twelve Gauge Records roster. Their blend of technical grindcore has caught the attention of many with the self-release of their debut EP "Rest Assured The End Is Upon Us." Dead Will Rise along with former drummer Alex Howard will enter the studio in March to record 8 new tracks for an upcoming EP effort that will be released on Twelve Gauge Records just before Summer 2007.

Vanmakt is currently mixing their debut album "Vredskapta Mörkersagor" that will be released through Pulverised Records in 2007. An exact release date will soon be announced. On this album Vanmakt has guest appearances from Jonas Renvaktar "Spawn Of Possession" on the song entitled "Open The gates" and Hebbe "Skald" on the Swedish entitled song "En Mardröm, En Strid, Ett Helvete".
In other news, Vanmakt is recording a video for the song "My Darkest Hate", that will be released on the forthcoming album. James Murphy will not master the album as previously planned and more info regarding this will follow soon. The final tracklist will be released at the end of next week.

London, UK's BORDEL is gearing up for an eventful 2007, totally intent on making waves all over the globe with a fistful of gothic metal attitude that's combined with a dedication to writing heavy songs with the literal independent spirit of the underground and a focused intent on making as many new fans of their music as humanly possible. A relatively new band, having only met its inception in 2002, this band is utterly fearless and makes no bones about what they strive to accomplish in an over crowded rock business that feeds off of the last hit band's newest failures. I think what makes Bordel a legitimate contender in the long run is that they don't seem seem to have much care for understanding of the market they are in and that unlike most who dare to break the mold for fear of not fitting the perfect formula, Bordel takes their route through the backdoor, not making a noise as they creep up on the first time listener and simply let their kick ass music do all the talking.
