According to The Associated Press, Behemoth frontman Adam "Negal" Darski was found innocent today in a Polish court, after being on trial for ripping pages out of a Bible and labelling it, "a deceitful book" at a concert in 2007. He was being charged for the crime of insulting religious feelings, an offense which can carry a sentence of two years imprisonment in the predominantly Catholic country of Poland. Darski was cleared of the charges when he explained that the show where the tearing took place was a closed event in which only those who had purchased tickets attended and knew what to expect, a statement held up when questioned audience members stated that they were not offended by Darski's actions or comments.

Yea I don't listen to much Behemoth but still very good news. He shouldn't have had to go through this crap in the first place. It's a fvckin' book. And there are thousands of them all over the world. It shouldn't matter if one book had some pages torn out of it......

f***, yeah. I knew Nergal would win. Hopefully this is foreshadowing for the elections to come. The judge here apparently said “The court will also examine whether Adam is a Satanist Darski dangerous for society and youth.” Stupid Ryszard Norwalk (error intended.) He can go back to potty training with his Bible on his lap. Glad the judge didn’t side with the histrionics. Nergal is now apparently a judge on Poland’s “The Voice.” Would like to see it.

This shouldn't have been an issue in the first place. Nothing more than a downright pathetic attempt by ultraconservatives to cut down somebody or something they don't like.

I wonder how Nergal deals with having so many idiots as fans.

I'm glad this situation has resolved the way it has, but I'm willing to bet that Nergal himself wouldn't want you to bash something just because he does. I love death metal but so many of it's fans are sheep just like the fans of mainstream culture.

Food for thought: I bet Nergal doesn't have the balls to rip up a Koran on stage.

Good to see you Drum_Junkie. It turns out the prosecution in both cases was seeking a fine, (worth about $1000), and not the maximum sentence of two years in jail. The right trying to force it’s views on others in the courts has failed in this situation (the religious right also failed to form the government in the last election,) as it has with the arts before. However, there have been others prosecuted who have attacked the church outright, or in media, internet, with what they call “false accusations.” Fines, letters of apology in papers, stuff like that. Those suits resemble Nergal’s earlier libel suit against Nowak when he slandered him with false accusations of being a criminal, and he wanted a letter of apology published in a paper and a payment worth about $1000 donated to an animal shelter. Very similar. Nergal had already scored a seat as a judge on Poland’s version of “The Voice” (apparently part of the deal is that he not talk about religion) and the case hadn’t even finished going through the courts. That didn’t sound like a man going to prison. It can be difficult to get information from Polish sources online. If you note the second issue the court addressed in the previous post, the language has gotten a little more colourful in the Behemoth news letter since he was found not guilty. If you google Nowak’s name in the image results there might be more pictures of Nergal or Doda than of Nowak himself. What is Nowak alone? Not much.

Same to you NWW!

Kinda wonder how much support Nowak continues to get from the right after two failed court cases against Nergal. He seems so bigoted and fanatical, that even the right might try to distance themselves from him. Then again, the right wing politics in the US seems to make that bigotry and fanatasicm a requirement (AKA tea party).

I don't know. The religious right certainly has their place in Poland, and rather than accept defeat and distance from Nowak, I would expect more of a hysterical spin "there goes your country, look what things are comming to, these satanists...vote for me." Whether or not they continue to waste their time in the court system after these defeats when attacking the arts is another question, which would definately be a positive gain.

Nowak doesn't even have to pay for these trials. They are paid for by the state. Taxpayers foot the bill. There is nothing stopping this guy from doing this indefinitely. Someone in the EU needs the balls to take on Section 196 of the penal code. "Insult of religious feelings" trials are ridiculous, and amount to a circus with taxpayers footing the bill indefinitely as mentally ill clowns like this guy Nowak has free reign to spend as much money as they like, without any penalty to themselves at all.

Poland has a concordant with the RC church, of which the constitution was written around, rather than vice versa, and it wasn't even voted in by members of parliament, just the leader of the country before he left office while parliament was out. It is set up as an international treaty whereby Poland cannot release itself from the treaty, until the Church decides. The church gets an insane amount of money, property, and privileges from the government of Poland. And people are starving. What I would like to know is where this "church" puts there political backing, if they pay anyone for their political ends, given they receive SO much money from the state. The unfortunate thing is when it comes down to it, I think the church will put it's backing behind anything that assures it's survival. Down to $, whether guys like Nowak succeed or not.

If guys like Nowak had had their way, these "insult to religious feelings" trials paid for by the state would be sanctioned and funds divvied out by the head of state, the King of Poland, no other than Jesus Christ. The state needs to stop enabling guys like Nowak from spending taxpayer's money without end in ill conceived witch trials based on past anticommunist rhetoric and inciting hysterical religious fanaticism on the state's buck. Go have a bake sale, Nowak. Pay for your own trials.

That means there is no reason that Nowak can't appeal. The day after the verdict there were polish sources stating that Nowak plans to appeal. We'll see if he's just milking the media circus or if it's just tabloid hype. At any rate, the consequences are not that grave. Nowak is a bug. This fool hops on the backs of celebrities like a parasite and takes in the sunshine. He can't even BUY better publicity, and it's paid for by the state!
