If look look at the chord structure at the end of Welcome Home and parts of Rush's Tom Sawyer, they are exaxtly the same, in the terms of they have the same chords progression. Exactly the same chords in the same order in fact (Tom Sawyer does not have the open E's though). But would anyone honestly mistake those two songs? No, I think not. It happens. Unless you happen to be in Creed, and then you are totally ripping off Pearljam.

Master of puppets was released on the 3rd of march 1986 and cliff burton died 27th of September 1986 on route to copenhagen... the first demo recorded for ...and justice for all was "ONE" on the 11th of november 1987. justice recording began 18th of january 1988.. cliff is still dead... completed on the 1st of May and it was released on the 6th of september 1988. go to http://www.metallica.com/timeline.asp and look at there timeline so you can learn about metallica's history so you don't say stuff that isn't true..we've all done it..from one fan to another..learn you metallica history my friend. Oh don't believe me that Mustaine has credit on that song? Go to www.metallica.com, check out the info there, Hetfield/Burton/Ulrich/Mustaine they all have credit on that song and a couple of others. Dave most certainly helped out.

As for the original thread here. I think there is a lot of similarity between the two. The /sound/ itself, and the progression of the riff in question are very very similar. Perhaps too similar to be coincidence? I don't know, nor do I really care. There have been much more blatant rip offs in musical history. Maybe they meant it as a heads up to Bleak House, maybe they wrote it being influenced by Bleak House and didn't even realize it, and maybe they liked the sound and lifted it for themselves. Only Metallica can really answer that, and I doubt they will do it publicly anyway.

Now about Metallica sucking after the Black Album.... well I don't much care for their new stuff. I seem to be able to find at least a song or two on all the "new" albums that I can dig, but over all I don't like their new sound nor where they are going. I still like Metallica, and I saw their closing show for this latest tour just a couple of weeks back in San Jose. They still put on a damn good show, and what I found interesting is they did mostly songs from Ride the Lightening, Master of Puppets and the Black Album. All the albums had a song or so done, but Master was almost completely played... oh and their "encore" was all Kill 'Em All. I think that says a LOT about the band and their realization that their old music is their core music. I'll buy the next Metallica album that comes out just for old times sake and I'll hope they find their "old" sound and soul. Until then, I just won't bother with the "new" stuff much.

They stopped playing "to live is to die" right after the black album was released. I totally agree with you, Justice was a great f***ing album but Puppets and Lightning IN MY OPINION were better albums. They collectively had better songs and were more consistent through out. Alot of that had to do with their frame of mind and not having Burton in the band. Justice was probably their heaviest album. The last concert I saw they only played One, Harvester, and the Justice medley (Blackened, Justice, and Eye of the beholder) off of the Justice album. They played alot of Kill 'em All and Garage Inc. covers through out the last hour of the show.

well yeah back to point...due its pretty obvious is resembles sanitarium...its the exact same structure and the same kinda of verse chord base..they just use the structure and used the verse riff as an inspiration to sanitarium...the melodies are in know way similar and neither is the chorus or the alternate melody at the end... they took the idea from the break with the palm muted open E but changed the tempo and made it a speed thing and yeah...sanitarium is still a wicked song alot better then rainbow warrior by bleak house..its not a rip off they just used the structure...alot of bands do that, just this is a unique structure kinda like 2 separate songs so its stands out more... i'll give those albums a go..thanks dude

Do you know exactly what Mustaine contributed to the writing process. Probably not. Nobody does. For all we know, Mustaine could have written the whole f***ing first album or just like hammet, all he could have done is write the solos. or, like in some cases, they might have just given him credit because he was part of the band and done f*** all. Clapton gets all the royaltys for writing "while my guitar gently weeps", but everybody knows who actually wrote the song. Just because his name is attached doesn't mean a damn thing. Besides James is so f***ing controlling there is almost no way that he lets anybody help him write the melodie to any metallica song. So he may have no right at all to rip anything off. Reading the album cover doesnt mean you actually know anything. So apparently knowing anything about metal is not a requirement to becoming mayor of whoville.
